{"id":32054,"date":"2026-07-01T04:32:39","date_gmt":"2026-07-01T08:32:39","guid":{"rendered":"https:\/\/design-providers.com\/rise\/pa-nj-de-join-medicaid-lawsuit-against-trump-administration\/"},"modified":"2026-07-01T04:32:40","modified_gmt":"2026-07-01T08:32:40","slug":"pa-nj-de-join-medicaid-lawsuit-against-trump-administration","status":"publish","type":"post","link":"https:\/\/design-providers.com\/rise\/pa-nj-de-join-medicaid-lawsuit-against-trump-administration\/","title":{"rendered":"PA, NJ, DE join Medicaid lawsuit against Trump administration"},"content":{"rendered":"<br \/>\n<h2>Medicaid work requirement exemptions<\/h2>\n<p>Over the last year, federal health officials stated that certain people and groups would be exempt from these requirements, including women who are pregnant or have recently given birth, people with disabilities or medical conditions, parents and caretakers of children age 13 and younger or people with disabilities, those in treatment for alcohol or drug addiction, American Indians, Alaska Natives, and others.\n<\/p>\n<p>The Centers for Medicare &amp; Medicaid Services released<a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.cms.gov\/newsroom\/fact-sheets\/medicaid-community-engagement-requirement-certain-individuals-interim-final-rule-comment-period-cms\"> interim guidance<\/a> on June 1 about how states should process medical frailty exemptions and under what circumstances.\n<\/p>\n<p>The definition stipulates that in addition to having a qualifying condition, people must prove that their medical frailty will \u201csignificantly impair their ability to comply with the [work] requirement,\u201d the federal agency stated.\n<\/p>\n<p>People will be able to self-attest their condition under the frailty definition throughout 2027 and once in 2028, but will then need to provide proof. Otherwise, they risk losing Medicaid health insurance.\n  <\/p>\n<p>Democrats in the lawsuit argue that the work requirements and exemption rules are unconstitutional and violate federal administrative procedural law.\n<\/p>\n<p>\u201cPeople with disabilities, patients in the middle of cancer treatment, or those struggling with another serious or complex health condition, shouldn\u2019t be at risk of losing the care that helps maintain their health,\u201d plaintiffs wrote in court documents. \u201cNowhere in H.R. 1 does Congress state that individuals\u2019 ability to work must be impaired in order to be \u2018medically frail or otherwise have special medical needs,\u2019 or to have a \u2018serious or complex medical condition.\u2019\u201d\n<\/p>\n<p>Pennsylvania Gov. Josh Shapiro blamed the president, Dr. Mehmet Oz, the head of the Centers for Medicare &amp; Medicaid Services, and Health Secretary Robert F. Kennedy Jr. \u201cfor trying to rip away Medicaid from Pennsylvanians who need it most.\u201d\n<\/p>\n<p>\u201cDonald Trump, Dr. Oz, and RFK Jr. are hellbent on trying to push aside people who rely on Medicaid to get the care they need,\u201d Shapiro said in a statement on social media. \u201cBut here in Pennsylvania, we\u2019re going to keep standing up to protect our most vulnerable
